TERMS AND CONDITIONS OF RENTAL AGREEMENT BETWEEN SOPHISTICAR
TRANSPORT & AUTO RENTALS, AND YOU, THE CUSTOMER.
BY SIGNING AND DATING THIS DOCUMENT, YOU HAVE AGREED TO ABIDE BY EACH OF
THE FOLLOWING TERMS AND CONDITIONS OF THIS CONTRACT
YOUR RESPONSIBILITIES
- You must always look after the vehicle, its accessories and the keys to the
Vehicle and utilise the highest standards of care during the rental period.
You must always lock the Vehicle when you are not using it and use any
security device fitted to or supplied with the Vehicle. You must always
protect the Vehicle against bad weather, which can cause damage. You
must always make sure that you use the correct fuel, check fluid levels daily
and adjust tyre pressures appropriately. - You shall and are responsible for at all times driving the Vehicle safely,
including observing the speed limits and traffic road signs, and always in
accordance with the Highway Code and other laws of Barbados. - You shall assume all liability that otherwise would be for the “owner” of the
Vehicle in respect of any fixed penalty offence or parking penalty issued
during the rental period regarding the Vehicle under or pursuant to the
Road Traffic Act of the laws of Barbados or any other road traffic laws,
regulations or bylaws. Further, you shall fully indemnify and reimburse
Sophisticar Transport & Auto Rentals for all costs, expenses and damages in
respect of any such liability arising. In addition, you shall immediately upon
Request provide us and any law enforcement bodies with full, accurate, and
up-to-date information required in relation to you and the driver (where
more than one driver is authorised, including, without limitation,n details
about the driver’s identity) relating to the use of the Vehicle during the
period of the rental agreement. We rely on you to fully comply with that
obligation to provide information. - You are responsible for any damage to the Vehicle caused by hitting low-
level objects, such as bridges or low branches and for damage caused by
off-road or beach use or flood. You must not modify the Vehicle in any way.
You shall assume all liability and shall fully indemnify and reimburse
Sophisticar Transport & Auto Rentals for all costs and expenses in respect
of any such damage arising. - You must not sell, rent or dispose of the Vehicle or any of its parts. You
shall not in any way attempt to give any third party any legal rights over the
Vehicle.
OUR RESPONSIBILITIES - We have maintained the Vehicle to at least the manufacturer’s
recommended standard. We assure you that the Vehicle is roadworthy and
suitable for renting at the start of the rental period. Also, if you are not
renting the Vehicle for business purposes, we are responsible for loss
caused by:
a) The vehicle did not match our description of it.
b) The Vehicle is not of the quality that you would be entitled to expect from a typical rental vehicle of a similar type and nature.
c)The Vehicle is not being fit to drive.
d) Us not have the legal right to rent out the Vehicle.
RENTAL PERIOD
We agree that you will have the vehicle for the rental period stated within the
agreement until the return date stated on the agreement summary. We may, in our sole
discretion, agree to extend this rental period, but the rental period shall never be more
than (3) three months unless authorised by Sophisticar Transport & Auto Rentals. We
may require you to pay an additional security deposit if we authorise an extended
rental period.
If you wish to extend the rental period stated within this contract, you must contact
Sophisticar Transport & Auto Rentals at least 24 hours before your rental ends with your
request. If no extension of the rental agreement period has been agreed to by
Sophisticar Transport & Auto Rentals, if you fail to return the vehicle on time, you are
breaching the conditions of this agreement. You can be charged the day rate applicable
for the rental period, along with any additional admin fees each day until the vehicle is
returned. Sophisticar Transport & Auto Rentals has the full right to reclaim the vehicle with
the assistance of relevant authorities if you fail to return the vehicle without reaching
out to us for an extension or if you adamantly insist on not fulfilling your commitment
to return our vehicle at the agreed-upon date and time. Your credit card will be charged all
relevant fees as suggested above, up until the time of return. Please read the following
as it pertains to rental extensions.
RENTAL EXTENSION
If you wish to extend the rental period, please contact us at (246) 247-7852 or email
sophisticar.bb@gmailcom with your request. We will require you to immediately settle
any additional fees once granted. If no extension is granted by Sophisticar Transport &
Auto Rentals, if you fail to return the vehicle on time or within your one-hour grace
period after your agreed-upon return date and time, it will be considered that you have
breached our terms and conditions; therefore, you will be charged a daily rate, along with
any extras added to the rental, and admin fees applicable for the period. Prices are
subject to change based on the rental rate at the given time. A day’s penalty will be
required for any early return of the vehicle before the agreed-upon return date and
time.
AUTHORIZATION HOLD:
There will be a minimum of $300.00 USD and possibly upwards to $1000.00 USD placed on hold as a security deposit for the
duration of the rental. This deposit may be increased to $1000.00 USD if no protection
packages are purchased. When the rental period has ended, the deposit will be
immediately released from our end, provided that the vehicle is returned in the same
condition as it was rented to the hirer at the commencement of the rental.
DRIVERS
You are authorised as the main driver of this vehicle; therefore, you remain entirely
responsible for this vehicle from the commencement of the rental period until the end. Any
additional drivers must be declared to Sophisticar Transport & Auto Rentals. If
authorised, an additional fee of $5.00 USD per day will be required for each additional
driver for as long as the additional driver/drivers continue to utilise this vehicle.
Sophisticar Transport & Auto Rentals allow a maximum of 3 three additional drivers. If
the vehicle is seen by any Sophisticar Transport & Auto Rentals staff member in the
possession of an unauthorised driver without any reasonable cause, then the company
will have full rights to reclaim the vehicle from your possession with no refund issued.
FUEL
Our vehicles are issued on a full tank of fuel; therefore, they must be returned on a full
tank of fuel. Failing to adhere to our full-to-full fueling policy will result in a charge of
$30.00 USD per, or to the closest gas station/bars. This charge will be taken from your
authorisation hold or can be remitted in cash on the rental's end.
LAW
The hirer shall not use the vehicle for any forms of illegal means in reference to our
Barbadian laws, if so, the hirer shall be held accountable. The hirer shall bear all traffic
and parking-related summons if incurred during the duration of the rental. If the cost of
any incurred traffic or parking fines is not settled before the rentals end, Sophisticar
Transport & Auto Rentals will have all rights to pull the payment due for any such fine
from the credit card on file, along with a fee of $25.00 USD for the commute to pay such
fine on behalf of the hirer.
TOWING
The vehicle must not be used for towing unless authorised in writing by Sophisticar.

DAMAGES/FAULTS
The hirer is responsible for any new damage caused to the vehicle's interior or exterior
which was not present at the time of check out. You shall not let anyone perform any
work on the vehicle; you shall notify us IMMEDIATELY upon becoming aware of any
faults with the vehicle. If any new damages inside or outside of the vehicle are incurred
while in the hirer’s possession, the company will have all rights to charge the hirer's
credit card with no further authorisation, to the extent of the protection package they
may have purchased. If no package was purchased, then all repair costs will be to the
expense of the hirer.
INSPECTION
A pre-rental inspection is conducted. The vehicle must be returned to the place and
time agreed upon, following up with a closing inspection by a Sophisticar representative
in the presence of the hirer. You are responsible as the hirer for the vehicle and its
condition. The hirer MUST NOT sell, rent, loan, modify or dispose of the vehicle or any
of its parts.
SMOKING
A 100% non-smoking policy is applied. If any evidence of smoking is discovered, the
hirer will incur a fee of $250.00 USD for valet.
PERSONAL POSSESSIONS
Before returning the vehicle, please ensure that you or no other parties have left any
personal belongings in the vehicle. The company will not be held accountable for such
personal items left in the vehicle, le nor for the return of such items to the hire.
PASSENGERS
The hirer will not exceed the total number of passengers permitted in the vehicle, or for
which the vehicle is designed.
ACCIDENTS
In the unfortunate event that an accident may occur, it is strongly advised that you
receive the names, addresses, witnesses, license plates and insurance company of the
involved party or parties of the collision. Ensure the vehicle is secured. Notify the police
(211) or ambulance (511) if anyone is hurt or there is any disagreement over who may
be responsible. Never assume liability; please call us immediately to report the matter.
TRACKING
The vehicle will be equipped with a tracking device or telematic system. You are
acknowledging and agreeing that they utilise personal data such as a telephone number,
satellite and radio signals to transmit data and communication so therefore privacy
cannot be guaranteed
AGE: You must be at least 25 years of age but no older than 75, & you must also be a
legal driver for a minimum of 3 years. If beyond age 75, a fit to drive note must
be provided from and stamped by a doctor’s office, but this will solely remain at the
discretion of Sophisticar.
